The Chief Justice of the Islamabad High Court has said that if India has any reservations in the Kulbhushan Jadhav case, it can approach the court.
The Islamabad High Court heard the government’s request to provide a lawyer to Kulbhushan Jadhav. Chief Justice Islamabad High Court Athar Minallah questioned whether an attempt had been made to remove the reservations of the Indian embassy.
The Attorney General took the position that India was deliberately refusing to be a part of the court proceedings, to which the Chief Justice remarked that we need assistance in implementing the decision of the International Court of Justice.
The Attorney General said India could be part of the proceedings through a lawyer, while India said it was against our sovereignty if we submitted a power of attorney.
The Chief Justice remarked that if India has any reservations, it can approach this court.
The Attorney General said that if India wanted consular access for the third time, Pakistan was ready to grant it.
The Chief Justice of Islamabad High Court asked the lawyer of the Indian High Commission how much time do they need to take instructions, upon which the Indian High Commission lawyer asked for a week’s time.
Chief Justice Athar Minallah has given two weeks time to the lawyer of Indian High Commission, during which he will also have to inform India about consular access.
The court adjourned the hearing of the case till December 1.
It should be noted that Indian spy Kulbhushan Jadhav was arrested on March 3, 2018 from the Pakistan-Iran border area. He was a serving officer of the Indian Navy and an agent of RAW.
Following the arrest of Jadhav, the government of Pakistan summoned the Indian ambassador and formally protested against the illegal entry of Indian spies into Pakistan and their involvement in terrorism in Karachi and Balochistan. After this, a video of Kulbhushan Jadhav’s confessional statement was released.
A month after his arrest, a case was registered against him under terrorism provisions in April 2018, after which a Pakistani military court convicted Kulbhushan Jadhav of involvement in terrorist activities and sentenced him to death.
